Registration
You may visit our website without registering. However, in order to download any of our products you will be required to register for an account. When creating an account we will collect your name, address, country of origin and email. If you decide to purchase any of our products, you will also be required to submit your PayPal or credit card information to our third party payment processors. We may also ask you for additional information if necessary.
By registering, you agree and represent as follows:
- You are of legal age and are otherwise capable of forming a legally binding contract;
- All information you submit to CreateandCode.com or in connection with our Service is accurate and complete and that you will maintain and promptly update any profile supplied to us to ensure accuracy at all times;
- You agree to be contacted via Email, SMS and text messaging by CreateandCode.com, and third parties if relevant, regarding CreateandCode.com services;
- You hereby grant CreateandCode.com permission to email or display your profile and such other information as may be supplied by you to us on or from our website as we shall deem advisable in our sole determination in connection with the Service or for marketing purposes thereof;
- By using the Service, you are granting us permission to access your account and those messages, data, information, text, graphics, audio, video or other material posted/uploaded/transmitted to or through the Service using your account, solely in connection with the provision of Services.
Theme Distribution License
Themes released directly via the Createandcode.com Shop are released under the GNU Public License version 2.0. Go create something awesome and share it with us!
Free Themes and Support
Updates will be provided for free themes for the lifetime of the product. Free themes are provided as is and we do NOT provide free support for free themes. To receive support for any of our themes a license for the pro version of the theme is required.
Createandcode.com Theme Support and Ongoing Updates License
While the theme is released under the GPL license, our time is not. Access to support and updates is based on the support license you purchase. At present our Theme Support and Ongoing Updates Licenses are as follows:
- Standard: 12 months support and updates
- Lifetime: Lifetime support and updates.
After your support license expires, if you require ongoing theme updates and support, you will be required to renew your license. Theme Licenses can be renewed at a 20% discount to the current new license purchase price. Please note: the 20% discount will be applied to the full price of the item at the time of renewal and not the price paid when the item was first purchased. We reserve the right to remove or alter the amount of discount given on renewals.
How do renewals work?
Our theme memberships automatically renew each year, with the exception of the lifetime membership which is a one-off payment for life. You are free to cancel your recurring payment at any time during the year and you will continue to receive theme updates and support until it expires.
Createandcode.com Theme Support Scope
The scope of support covers help with setting the theme up to work like the theme demo and direction on how to use the product as advertised. Theme support scope also includes investigating any theme bugs reported. If we determine that a bug is reproducible and is specifically related to the theme our support team will do their best to resolve the issue under theme support.
Our theme support specifically does not include any help or guidance with theme customisation requests. Theme customisation includes questions about how to change the look and feel of the theme (beyond the controls within the theme), how to add new things to the theme not in the theme demo and issues arising with the use of the theme with plugins not tested with the theme. We do offer paid customisations and can give you an estimate for any such customisation requests.
Refund Policy
If you have difficulty getting a theme purchased via the Createandcode.com Shop to work, you agree to allow us to try and help solve any issues you have by opening a ticket with our Support Team (see Support above). In the event, that our support team declares the theme to be broken or unusable we will be happy to provide you with a full refund within 10 days of the original purchase date. After 10 days, no refunds will be permitted.
Payments
For your security, we do not store your credit card or payment information on our site. Payments are processed securely via Paypal and Stripe. Only after your purchase has been completed and payment has been received will you be granted access to your theme download and support.
Theme Updates
We check our themes with major new releases of WordPress and WooCommerce. For supported themes, we endeavour to ensure our themes remain compatible with the latest versions of both WordPress and WooCommerce within a short timeframe of major releases. Theme updates will be available to download from your WordPress dashboard providing you have a valid and current theme license.
Price Changes
We reserve the right to modify or discontinue, temporarily or permanently, prices of all products, at any time with or without notice.
Liability
In no event will Createandcode.com, or its suppliers or licensors be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials offered on this site. Even if Createandcode.com or an authorized representative has been advised of the possibility of such damages. If your use of downloads from this site results in the need for servicing, repair, or correction of equipment or data, you assume any costs thereof.
Warranty
Our products are provided “as is” without warranty of any kind, either expressed or implied. We do not guarantee that themes will work in all browsers, nor do we guarantee that our themes will be functional with all versions of WordPress. We do not guarantee compatibility with any additional third party plugins, scripts, or applications.
We test our themes to modern standards and the most recent versions of WordPress and WooCommerce.
Termination
Createandcode.com may terminate your access to all or any part of the website at any time, with or without cause, with or without notice. If you wish to terminate this agreement, you may simply discontinue using the website. All provisions of this agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Changes
Createandcode.com reserves the right, at its sole discretion, to modify or replace any part of this agreement. It is your responsibility to check this agreement periodically for changes. Your continued use of or access to the website following the posting of any changes to this agreement constitutes acceptance of those changes.
